1. Introduction & Acceptance
These Terms of Service ("Terms") govern your use of NHTaxAppeal.com (the "Website") and your engagement with NHTaxAppeal.com and Mike VanVickle (the "Company," "we," "us," or "our") for property tax abatement consulting services in New Hampshire.
By accessing our Website or submitting a service request, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Website or our services. These Terms apply to all visitors, users, and others who access or use our Website or services.
2. Services Description
NHTaxAppeal.com provides property tax abatement consulting services for residential and commercial properties in New Hampshire. Our services include:
- Free preliminary assessment of your property's overvaluation
- Preparation and filing of property tax abatement applications with town Selectmen
- Representation in negotiations with local assessors
- Appeal representation before the Board of Tax and Land Appeals (BTLA) if needed
- Communication with town officials and assessors on your behalf
Services are provided on a contingency basis: we charge 30% of the first-year tax savings achieved. If we do not win an abatement or reduce your tax liability, you pay nothing.
3. No Guarantee of Results
While we work diligently on your behalf, we cannot guarantee any specific outcome or tax reduction. Property tax abatement decisions are made by town Selectmen and, on appeal, by the Board of Tax and Land Appeals. These decisions are based on law, valuation methodology, and the evidence presented. Outcomes depend on the strength of comparable sales data, market conditions, property characteristics, and the judgment of the decision-makers.
We estimate win probability based on our experience, but no estimate is a promise. Your property may not qualify for an abatement, or the abatement granted may be smaller than anticipated.
4. Contingency Fee Model
Upfront Cost: There is no upfront fee for initial consultation and assessment. The free assessment is non-binding and places you under no obligation to hire us.
Success Fee: If we file an abatement and win a reduction in your assessed value or tax liability, we charge 30% of the first-year tax savings (the difference between the original tax bill and the new tax bill for that tax year only).
No Win, No Fee: If we file an abatement and do not win any reduction, you pay nothing. If we appeal to BTLA and lose, you pay nothing.
Payment Terms: If we win, you pay our fee from the tax savings achieved. For example, if we win a $6,000 annual tax reduction, we receive $1,800 (30%), and you keep $4,200 in year one. In year two and beyond, you keep the full savings unless the assessment is reviewed and changed.
5. Client Responsibilities
To work effectively on your behalf, you agree to:
- Provide accurate and complete information about your property, ownership, and financial details
- Provide requested documents promptly (deed, tax bills, leases, financial statements, etc.)
- Be available for meetings and discussions as needed
- Respond to requests for information from the Company or town assessors
- Notify us immediately of any changes to your contact information or property ownership
- Disclose all relevant information about the property, including liens, disputes, or other issues
If you fail to provide requested information or cooperate in the abatement process, we may withdraw from representation and you will remain responsible for any fees owed.
6. Confidentiality & Privilege
Communications between you and NHTaxAppeal.com are confidential. We will not disclose your personal or financial information to third parties except as required by law or with your written consent. Information provided to us for the purpose of obtaining abatement advice may be protected by attorney-client privilege or consultant-client confidentiality, depending on the nature of the engagement.
7. Limitation of Liability
To the fullest extent permitted by New Hampshire law, NHTaxAppeal.com shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Website or our services, including lost profits, lost revenue, or lost opportunity, even if we have been advised of the possibility of such damages.
Our total liability for any claim related to the Website or services shall not exceed the amount you paid us (if any).
8. Termination of Services
Either party may terminate the engagement at any time. If you terminate before we file an abatement application, you owe nothing. If we have already filed and subsequently withdraw, you remain responsible for any administrative fees incurred.
If we win an abatement and later terminate for any reason, you remain responsible for our contingency fee based on the achieved savings, even if the engagement ends before the final payment.
9. Governing Law & Jurisdiction
These Terms and any engagement for services shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law principles. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of New Hampshire, and you agree to submit to personal jurisdiction in those courts.
10. Professional Services Disclaimer
NHTaxAppeal.com provides property tax abatement consulting services. Our services may include advice on property valuation, appraisal methodology, and tax law related to property assessment. However, we are not attorneys and do not provide legal advice. For questions involving complex legal issues, you should consult with a licensed attorney.
We are licensed property tax consultants in New Hampshire and comply with all applicable state laws and regulations.
